Terms of Service

These terms apply to the use of the Shopify app "Eazign" by Metacom Solutions, Gerald Kapp, Fasangasse 28/2, 8075 Hart bei Graz, Austria ("we") by merchants ("you"). The app is intended for businesses only; consumers are not contracting parties. The German version is binding.
1. Contract and service
The contract is concluded when you install the app in your Shopify store. Eazign provides a product designer for your customers, print file creation, a product generator with mockups and scene images, and the related administration. The exact scope follows from the App Store listing and the chosen plan. You need an active Shopify store to use it.
2. Plans, trial and payment
The app is offered in plans billed monthly or yearly; prices and limits are shown in the app under "Plan & billing". New subscriptions start with a free 14-day trial. Charges are billed through your Shopify invoice; Shopify's terms apply as well. You can change your plan at any time. Uninstalling ends the subscription; billing periods already started are handled according to Shopify's rules.
3. Plan limits
Each plan has limits, e.g. for designer products, generated products, scene images and orders with print files per month. When a limit is reached, you cannot add more items of that kind until you change your plan or the next month starts. Print files for orders are still created above the limit; we then point you to a suitable plan.
4. Your content and your customers' content
You are responsible for holding the rights to the motifs, photos, texts and fonts you use in the app. For designs your customers create or upload, you are the contracting party towards your customers: please check before printing whether content infringes third-party rights or is unlawful. You grant us the rights we need to store, process and display this content for the app – and only for that.
5. Print files and print results
Eazign creates print files in the size and resolution defined by your blank and the design, and warns about low image resolution. Please check print files before production. We are not liable for color deviations, print results or errors in your customers' designs.
6. Availability and changes
We operate the app with the care of a prudent business and aim for high availability, but cannot guarantee it, in particular during maintenance or outages of Shopify or our hosting provider. We continue to develop the app and may change features as long as the essential scope of your plan is kept.
7. Liability
We are liable without limitation for intent and gross negligence and for personal injury. For slight negligence we are only liable for breaches of essential contractual obligations, limited to the foreseeable, typical damage and at most to the fees you paid for the app in the last 12 months. For slight negligence we are not liable for lost profits and indirect damages. Please keep your own copies of important print files.
8. Data protection
We process personal data of your customers on your behalf. The data processing agreement at /dpa applies and is part of these terms. How we handle data is described in the privacy policy at /privacy.
9. Term and termination
You can terminate at any time by uninstalling the app. We may terminate with 30 days' notice by email, or immediately for good cause (e.g. unlawful use). Afterwards your data is deleted according to the data processing agreement.
10. Changes to these terms
We announce changes at least 30 days in advance by email or in the app. If you keep using the app afterwards, the new terms apply; you may terminate instead at any time.
11. Governing law and jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and conflict-of-law rules. Place of jurisdiction is the competent court in Graz. Contact: dev@metacom.at.
